Article 1 — Promoter
Mehdi Grar, a sole trader (entrepreneur individuel) registered with the French National Business Register (Registre National des Entreprises, RNE) under SIREN number 790 231 468, whose registered address is 136 rue de l'Église, 74970 Marignier, France (the "Promoter"), publisher of the Quizelo mobile application (the "App"), is running a free prize competition, with no purchase necessary, called the "Tournament" (the "Tournament"), where applicable in partnership with a third-party advertiser (the "Partner").
Any question about the Tournament may be sent to: contact@quizelo.app.
Article 2 — Nature and purpose of the Tournament
The Tournament is a skill-based competition that rewards, on merit, the best entrants in a timed general-knowledge event (a "sprint"). Winners are determined solely on the basis of their performance (the accuracy and speed of their answers), with no element of chance.
Entry is free and no purchase is necessary (see Article 5), and the ranking involves no element of chance. The Tournament is neither a lottery nor a game of money and chance within the meaning of Articles L. 320-1 et seq. of the French Internal Security Code. It falls under the rules applicable to promotional operations.
For entrants resident in the United Kingdom, the Tournament is a skill-based prize competition and not a lottery within the meaning of the Gambling Act 2005; it is run in accordance with the UK Code of Non-broadcast Advertising and Direct & Promotional Marketing (CAP Code).
Article 3 — Duration and frequency
The Tournament is recurring (indicative frequency: one edition per weekend). Each edition runs over a window announced within the App (by default from Friday to Sunday evening, Paris time), at the end of which the ranking is frozen and prizes are awarded.
For each edition, the opening and closing dates and times (Paris time) are announced within the App. Once the closing time is reached, runs already in progress may be completed, but no new run may be started; the ranking is then frozen. The timestamp of the Promoter's servers is authoritative. The Promoter reserves the right to extend, shorten, postpone or amend these dates under the conditions of Article 12.
Article 4 — Eligibility
4.1. The Tournament is open to any natural person aged 16 or over on the date of entry, resident in metropolitan France, Belgium, Switzerland or the United Kingdom, and holding a valid account on the App.
4.2. Entrants who are minors must have obtained the prior authorisation of their parent or legal guardian, both to take part and to accept and receive any prize, regardless of their country of residence. The Promoter may request proof of this and, failing that, may disregard the entry. A minor winner's prize is handed over in the presence of, and with the agreement of, their parent or legal guardian.
4.3. Entry is strictly personal and limited to one account per person (see Article 7).
4.4. The Promoter's and the Partner's directors and employees, together with members of their immediate family living in the same household, are excluded from entry.
4.5. Entry implies full and unreserved acceptance of these rules (see Article 13).
Article 5 — Entry, attempts and no purchase necessary
5.1. Number of attempts. Each entrant may play a maximum of 5 runs (attempts) per edition of the Tournament. This limit is the same for all entrants, without any distinction relating to Premium subscription or account status.
5.2. First run free. The first run is free. Each of the following runs (up to 4 additional runs, i.e. 5 in total) requires a ticket, obtained by means of Points, an in-game currency earned by playing the App for free. Points cannot be purchased with real money, have no monetary value, and are neither transferable nor convertible into cash.
5.3. No purchase necessary. Accordingly, no purchase is necessary to enter the Tournament: every entrant can compete for free (first run) and obtain the additional runs simply by playing. Premium subscription confers no advantage: the number of attempts (5) and the scoring table are the same for everyone. The ranking is based on each entrant's best run and not on the number of runs; a greater number of attempts therefore guarantees no ranking.
5.4. The number of tickets held or of runs played is not part of the score calculation and confers no ranking points.
Article 6 — Mechanics and determination of winners
6.1. Format. A run is a series of timed questions played solo. Each answer is scored according to a skill-based scoring table announced for the edition, rewarding accuracy and speed (base points per correct answer, speed bonus and correct-streak multiplier). The score of a run is the sum of the points thus earned.
6.2. Ranking. Each entrant's ranking is established on the basis of their best run of the edition. When the Tournament closes, a general ranking is frozen in decreasing order of best score.
6.3. Tie-break. In the event of an equal best score, the entrant who reached that score first ranks ahead (earlier timestamp recorded by the App).
6.4. The winners are the entrants occupying the ranks or tiers that carry a prize, as announced for the edition (Article 7).
6.5. Only scores properly earned in accordance with these rules are taken into account; the Promoter excludes from the ranking any fraudulent or non-compliant entry (Article 7).
Article 7 — Prizes
7.1. The prizes for the current edition (nature, value, rewarded ranks or tiers) are announced within the App. They may include Points credited automatically at the end of the tournament and/or a prize provided by the Promoter or the Partner. Points are a game reward, with no monetary value and no conversion into cash.
7.2. Prizes in kind cannot give rise to any cash alternative, exchange for their cash value, or transfer to a third party, except with the Promoter's express agreement. If a prize is unavailable, the Promoter may replace it with a prize of equivalent nature and value; the images are not contractual.
7.3. Verification before award. Before awarding a prize in kind or of value, the Promoter may carry out any relevant checks (authenticity of the runs, identity, uniqueness of account, eligibility). Runs showing signs of automation or non-genuine behaviour may be excluded from the ranking after examination. Failing valid supporting evidence within the time allowed, the winner is deemed to have declined their prize.
7.4. The Tournament is not sponsored, endorsed or administered by, nor associated in any way with, Apple Inc. or Google LLC; those companies cannot be held liable for any claim relating to the prizes or the running of the Tournament. Any Partner's brand and images remain the property of their respective owners.
Article 8 — Fraud, disqualification and multiple accounts
8.1. Any use of more than one account by the same person results in the disqualification of all the accounts concerned.
8.2. The following are in particular prohibited and result in disqualification: the use of bots, scripts, emulators or any automated process (including to answer faster than humanly possible); the manipulation of runs; and any conduct contrary to these rules or liable to distort the ranking.
8.3. The Promoter reserves the right to carry out any relevant checks and to exclude, at any time and without notice, any entrant in the event of proven fraud or attempted fraud, without prejudice to any legal action. An excluded entrant loses all right to a prize.
Article 9 — Liability
9.1. The Promoter cannot be held liable for malfunctions of the network, the App, or entrants' hardware or software, nor for any event beyond its control affecting the running of the Tournament. In the event of a technical interruption affecting a run, the Promoter may, at its discretion, void the affected run without incurring any liability.
9.2. The Promoter cannot be held liable for the loss, theft or damage of a prize during delivery, nor for incorrect or incomplete details provided by the winner.
Article 10 — Announcement and delivery of prizes
10.1. Winners are notified individually, at the end of the edition, via the App and/or the email address associated with their account. Points prizes are credited automatically. Winners' usernames may be announced on Quizelo's communication channels, under the conditions of Article 11.
10.2. For a prize in kind, the winner has 15 days from notification to confirm acceptance and provide the information needed for delivery (identity, postal address and, for minors, the parent or guardian's agreement). After this period, or if the winner cannot be reached, or if the details are invalid, the prize is deemed declined and may be awarded to the next entrant in the ranking or cancelled, at the Promoter's choice.
10.3. Digital prizes are delivered online. For a physical prize delivered to a winner resident in Switzerland or the United Kingdom (outside the European Union), delivery may give rise to customs duties and/or import VAT; to avoid charging these to the winner, the Promoter may, at its option, source the prize from a local distributor, failing which such charges remain the winner's responsibility.
Article 11 — Personal data and communication
The data collected (username, email address, game data and, for winners, the information needed for delivery) are processed by the Promoter, as data controller, solely to manage the Tournament, draw up the ranking, contact winners, deliver prizes and communicate the results. Where a prize is provided by a Partner, only the data strictly necessary for delivery may be passed to that Partner or its logistics provider, who are bound by confidentiality; no data are transferred for commercial purposes without the entrant's consent.
- Legal basis: performance of these rules and, where applicable, consent for optional communications.
- Retention: for as long as necessary to manage the Tournament and deliver the prizes, plus any applicable statutory retention periods, and then deletion or anonymisation.
- Rights: access, rectification, erasure, restriction, objection, portability, by writing to contact@quizelo.app. A complaint may be lodged with the competent authority: the CNIL in France (www.cnil.fr); the ICO in the United Kingdom (ico.org.uk); the FDPIC in Switzerland. Processing complies with the GDPR, the UK GDPR / Data Protection Act 2018 (UK entrants) and the nFADP (Swiss entrants).
By the sole fact of entering, each winner authorises the Promoter to publish their username and rank on Quizelo's communication channels, for the purpose of announcing the results, without any right to payment. Any use beyond this (name, image, testimonial) is subject to their separate express agreement and, for a minor, that of their parent or legal guardian. To comply with the UK CAP Code, the Promoter will make available, on request sent to contact@quizelo.app, the surname and county of the winners of the main prizes resident in the United Kingdom; any winner may object to this publication without this affecting their right to their prize.
Article 12 — Amendment or cancellation
The Promoter may amend, extend, shorten, suspend or cancel an edition of the Tournament in the event of force majeure, lasting technical impossibility, large-scale fraud compromising the integrity of the ranking, a change in law or regulation, a Partner's failure, or a decision by an authority or distribution platform preventing operation of the App. Any amendment is brought to entrants' attention within the App before it takes effect and may not deprive an entrant of rights already acquired. If an edition is cancelled, prizes owed to winners already determined remain theirs.
Article 13 — Acceptance of the rules
Entry into the Tournament implies unreserved acceptance of these rules and of the applicable laws and regulations. Breach of the rules results in the entrant's exclusion.
Article 14 — Availability of the rules
These rules are available free of charge throughout each edition within the App and on the Quizelo website.
Article 15 — Disputes and governing law
These rules are governed by French law. For entrants resident in Belgium, Switzerland or the United Kingdom, the mandatory consumer-protection provisions of their country of residence remain reserved, and those entrants keep the right to bring proceedings before the courts of their country of residence where the applicable law guarantees them that right. Any complaint must be sent in writing to contact@quizelo.app within 30 days of the end of the relevant edition. Failing an amicable resolution, any dispute will be submitted to the competent French courts, subject to the mandatory jurisdiction rules applicable to consumers.
