Article 1 — Promoter

Mehdi Grar, a sole trader (entrepreneur individuel) registered with the French National Business Register (Registre National des Entreprises, RNE) under SIREN number 790 231 468, whose registered address is 136 rue de l'Église, 74970 Marignier, France (the "Promoter"), publisher of the Quizelo mobile application (the "App"), is running a free prize competition, with no purchase necessary, called the "Referral Challenge" (the "Challenge").

Any question about the Challenge may be sent to: contact@quizelo.app.

Article 2 — Nature and purpose of the Challenge

The Referral Challenge rewards, on merit, the entrant who has referred the greatest number of qualified referrals (as defined in Article 5) on the App during the period of the current edition. Winners are determined solely on the basis of that count, with no element of chance.

Entry is free and no purchase is necessary, and the ranking involves no element of chance. The Challenge is neither a lottery nor a game of money and chance within the meaning of Articles L. 320-1 et seq. of the French Internal Security Code. It falls under the rules applicable to promotional operations.

For entrants resident in the United Kingdom, the Challenge is a skill-based prize competition and not a lottery within the meaning of the Gambling Act 2005; it is run in accordance with the UK Code of Non-broadcast Advertising and Direct & Promotional Marketing (CAP Code).

Article 3 — Duration and cadence

The Referral Challenge is recurrent (indicative cadence: two months per edition). Only one edition is active at a time.

For each edition, the opening and closing dates (Paris time) are announced within the App. Only referrals qualified during the period of the current edition are taken into account in the ranking; the timestamp of the Promoter's servers prevails. The Promoter reserves the right to extend, shorten, postpone or amend these dates under the conditions set out in Article 12.

Article 4 — Eligibility

4.1. The Challenge is open to any natural person aged 16 or over on the date of entry, resident in metropolitan France, Belgium, Switzerland or the United Kingdom, and holding a valid account on the App.

4.2. Entrants who are minors must have obtained the prior authorisation of their parent or legal guardian, both to take part and to accept and receive any prize, regardless of their country of residence. The Promoter may request proof of this and, failing that, may disregard the entry concerned. A minor winner's prize is handed over in the presence of, and with the agreement of, their parent or legal guardian.

4.3. Entry is strictly personal and limited to one account per person (see Article 7).

4.4. The Promoter's directors and employees, together with members of their immediate family living in the same household, are excluded from entry.

4.5. Entry implies full and unreserved acceptance of these rules (see Article 13).

Article 5 — Referral mechanics and determination of the winners

5.1. Invitation. Each entrant has, within the App, a personal referral code. A person becomes their "referred player" when they create an account entering that code. The referral link is unique and final: a referred player can be attached to only one referrer.

5.2. Qualified referral. For the purposes of the ranking, only a qualified referral is counted, that is, a referred player who, cumulatively:

  • signed up via the entrant's code during the current edition;
  • has verified their email address;
  • has completed at least 10 games on the App;
  • signed up from a unique device (the same device cannot validate more than one referred player).

5.3. Ranking. When the edition closes, a ranking is drawn up in decreasing order of the number of qualified referrals. The entrant ranked 1st is declared the winner (number of qualified referrals strictly greater than zero).

5.4. Tie-break. In the event of an equal score, the entrant who reached that total first ranks ahead (earlier timestamp recorded by the App).

5.5. Fair referring. The entrant undertakes to solicit referred players only with respect for the people concerned (prior consent) and in accordance with the terms of use of the third-party platforms used for the invitation.

5.6. Game rewards (separate from prizes). Independently of the Challenge ranking, the App may credit the referrer and the referred player with points, an in-game currency, on reaching certain milestones (for example first game, ten games, Premium subscription). These points have no monetary value, are neither transferable nor convertible into cash, and have no effect on the Challenge ranking or on the award of the prize.

Article 6 — Prize

The prize for the current edition is announced within the App. Unless otherwise stated for a particular edition, it rewards the 1st in the referral ranking and consists of a tablet (model subject to availability).

  • The prize cannot give rise to any cash alternative, exchange for its cash value, or transfer to a third party, except with the Promoter's express agreement.
  • If it is unavailable, the Promoter may replace it with a prize of equivalent nature and value. Prize images are for illustration only and are not contractual.
  • The Challenge is not sponsored, endorsed or administered by, nor associated in any way with, Apple Inc. or Google LLC. Those companies cannot be held liable for any claim relating to the prize or the running of the Challenge.

Article 7 — Fraud, disqualification and multiple accounts

7.1. Any use of more than one account by the same person results in the disqualification of all the accounts concerned. Any abuse (fake accounts, fictitious referred players, self-referral) results in the suspension of the account and the cancellation of the points and rankings acquired.

7.2. The following, in particular, are prohibited and result in disqualification: creating fake accounts or fictitious referred players; self-referral; using bots, scripts, emulators or any automated process; and any conduct contrary to these rules or liable to distort the ranking. Self-referral is technically blocked and non-qualified referrals (unverified email, fewer than 10 games, device already used) do not count.

7.3. The Promoter reserves the right to carry out any relevant checks (in particular of identity, account uniqueness and device uniqueness) and to exclude, at any time and without notice, any entrant in the event of proven fraud or attempted fraud, without prejudice to any legal action. An excluded entrant loses all right to a prize.

Article 8 — Liability

8.1. The Promoter cannot be held liable for malfunctions of the network, the App, or entrants' hardware or software, nor for any event beyond its control affecting the running of the Challenge.

8.2. The Promoter cannot be held liable for the loss, theft or damage of the prize during delivery, nor for incorrect or incomplete details provided by the winner.

Article 9 — Announcement and delivery of the prize

9.1. The winner is notified individually, once the edition ends, via the App and/or the email address associated with their account. The winner's username may be announced on Quizelo's communication channels, under the conditions of Article 11.

9.2. The winner has 15 days from notification to confirm acceptance of their prize and provide the information needed for delivery (identity, postal address and, for minors, the parent or guardian's agreement). After this period, or if the winner cannot be reached, or if the details are invalid, the prize is deemed declined and may be awarded to the next entrant in the ranking or cancelled, at the Promoter's choice.

9.3. The physical prize is dispatched at the Promoter's expense to the address provided by the winner. For a winner resident in Switzerland or the United Kingdom (outside the European Union), delivery may give rise to customs duties and/or import VAT; the Promoter may, at its option, source the prize from a local distributor to avoid charging these to the winner, failing which such charges remain the winner's responsibility.

Article 10 — Personal data

The data collected (username, email address, activity and referral data and, for the winner, the information needed for delivery) are processed by the Promoter, as data controller, solely to manage the Challenge, draw up the ranking, contact the winner, deliver the prize and communicate the results.

  • Legal basis: performance of these rules to which the entrant has agreed and, where applicable, consent for optional communications.
  • Retention: for as long as necessary to manage the Challenge and deliver the prize, plus any applicable statutory retention periods, and then deletion or anonymisation.
  • Rights: access, rectification, erasure, restriction, objection and portability, by writing to contact@quizelo.app. A complaint may be lodged with the competent authority: the CNIL in France (www.cnil.fr); the ICO in the United Kingdom (ico.org.uk); the FDPIC in Switzerland. Processing complies with the GDPR, the UK GDPR / Data Protection Act 2018 (UK entrants) and the nFADP (Swiss entrants).

The referred player is informed, when signing up via a code, that their attachment to a referrer and their progress (number of games, qualification status) are processed for the purposes of this Challenge. No data of the referred player other than their qualification status is disclosed to the referrer.

Article 11 — Communication of results

By the sole fact of entering, the winner authorises the Promoter to publish their username and rank on Quizelo's communication channels, for the purpose of announcing the results, without this use giving rise to any right to payment. Any use beyond this (name, image, testimonial) is subject to their separate express agreement and, for a minor, that of their parent or legal guardian. To comply with the UK CAP Code, the Promoter will make available, on request sent to contact@quizelo.app, the surname and county of a winner resident in the United Kingdom, any winner being able to object to this publication without this affecting their right to the prize.

Article 12 — Amendment or cancellation

The Promoter may amend, extend, shorten, suspend or cancel an edition of the Challenge in the event of force majeure, lasting technical impossibility, large-scale fraud compromising the integrity of the ranking, a change in law or regulation, or a decision by an authority or a distribution platform preventing operation of the App. Any amendment is brought to entrants' attention within the App before it takes effect and may not deprive an entrant of rights already acquired. If an edition is cancelled, the prize owed to a winner already determined remains theirs.

Article 13 — Acceptance of the rules

Entry in the Challenge implies unreserved acceptance of these rules and of the applicable laws and regulations. Breach of the rules results in the entrant's exclusion.

Article 14 — Availability of the rules

These rules are available free of charge throughout each edition within the App and on the Quizelo website.

Article 15 — Disputes and governing law

These rules are governed by French law. For entrants resident in Belgium, Switzerland or the United Kingdom, the mandatory consumer-protection provisions of their country of residence remain reserved, and those entrants keep the right to bring proceedings before the courts of their country of residence where the applicable law guarantees them that right. Any complaint must be sent in writing to contact@quizelo.app within 30 days of the end of the relevant edition. Failing an amicable resolution, any dispute will be submitted to the competent French courts, subject to the mandatory jurisdiction rules applicable to consumers.
