Article 1 — Promoter
Mehdi Grar, a sole trader (entrepreneur individuel) registered with the French National Business Register (Registre National des Entreprises, RNE) under SIREN number 790 231 468, whose registered address is 136 rue de l'Église, 74970 Marignier, France (the "Promoter"), publisher of the Quizelo mobile application (the "App"), is running a free prize competition, with no purchase necessary, called the "Marathon Challenge" (the "Challenge").
Any question about the Challenge may be sent to: contact@quizelo.app.
Article 2 — Nature and purpose of the Challenge
The Marathon Challenge is an endurance competition rewarding, on merit, the entrant who has completed the greatest number of games on the App during the period of the current edition. Winners are determined solely on the basis of this count, with no element of chance.
Entry is free and no purchase is necessary, and the ranking involves no element of chance. The Challenge is neither a lottery nor a game of money and chance within the meaning of Articles L. 320-1 et seq. of the French Internal Security Code. It falls under the rules applicable to promotional operations.
For entrants resident in the United Kingdom, the Challenge is a skill-based prize competition and not a lottery within the meaning of the Gambling Act 2005; it is run in accordance with the UK Code of Non-broadcast Advertising and Direct & Promotional Marketing (CAP Code).
Article 3 — Duration and frequency
The Marathon Challenge is recurring: it is reset at each new edition (indicative frequency: monthly). Only one edition is active at a time.
For each edition, the opening and closing dates (Paris time) are announced in the App. Only games completed during the period of the current edition are taken into account; the timestamp of the Promoter's servers is authoritative. The Promoter reserves the right to extend, shorten, postpone or amend these dates under the conditions set out in Article 12.
Article 4 — Eligibility
4.1. The Challenge is open to any natural person aged 16 or over on the date of entry, resident in metropolitan France, Belgium, Switzerland or the United Kingdom, and holding a valid account on the App.
4.2. Entrants who are minors must have obtained the prior authorisation of their parent or legal guardian, both to take part and to accept and receive any prize, regardless of their country of residence. The Promoter may request proof of this and, failing that, may disregard the entry concerned. A minor winner's prize is handed over in the presence of, and with the agreement of, their parent or legal guardian.
4.3. Entry is automatic and free: any game completed during the edition enters the entrant into the ranking, with no prior registration or fee. It is strictly personal and limited to one account per person (see Article 7).
4.4. The Promoter's directors and employees, together with members of their immediate family living in the same household, are excluded from entry.
4.5. Entry implies full and unreserved acceptance of these rules (see Article 13).
Article 5 — Mechanics and determination of the winners
5.1. Each completed game on the App during the edition adds 1 point to the entrant's Marathon score. There is no cap on the number of games.
5.2. Only games played through to the end are counted: abandoned or interrupted games do not count. Only games played by genuine entrants are credited.
5.3. When the edition closes, a ranking is drawn up in decreasing order of the number of completed games. The entrant ranked 1st is declared the winner (score strictly greater than zero).
5.4. Tie-break. In the event of an equal score, the entrant who reached that total first ranks ahead (earlier timestamp recorded by the App).
5.5. Only scores properly earned in accordance with these rules are taken into account; the Promoter excludes any fraudulent or non-compliant entry (Article 7).
Article 6 — Prize
The prize for the current edition is announced in the App. Unless otherwise specified for a particular edition, it consists of a gift card worth €50 (or the equivalent in pounds sterling for a winner resident in the United Kingdom), the retailer being the winner's choice from the options offered by the Promoter.
- The prize cannot give rise to any cash alternative, exchange for its cash value, or transfer to a third party, except with the Promoter's express agreement.
- If it is unavailable, the Promoter may replace it with a prize of equivalent nature and value.
- The Challenge is not sponsored, endorsed or administered by, nor associated in any way with, Apple Inc. or Google LLC; those companies cannot be held liable for any claim relating to the prize or the running of the Challenge.
Article 7 — Fraud, disqualification and multiple accounts
7.1. Any use of more than one account by the same person results in the disqualification of all the accounts concerned.
7.2. The following, in particular, are prohibited and result in disqualification: using bots, scripts, emulators or any automated process; manipulating games; and any conduct contrary to these rules or liable to distort the ranking (for example, playing games in succession for the sole purpose of artificially inflating the score by inauthentic means).
7.3. The Promoter reserves the right to carry out any relevant checks and to exclude, at any time and without notice, any entrant in the event of proven fraud or attempted fraud, without prejudice to any legal action. An excluded entrant loses all right to a prize.
Article 8 — Liability
8.1. The Promoter cannot be held liable for malfunctions of the network, the App, or entrants' hardware or software, nor for any event beyond its control affecting the running of the Challenge.
8.2. The Promoter cannot be held liable for the loss, theft or damage of the prize during delivery, nor for incorrect or incomplete details provided by the winner.
Article 9 — Announcement and delivery of the prize
9.1. The winner is notified individually, once the edition has ended, via the App and/or the email address associated with their account. The winner's username may be announced on Quizelo's communication channels, under the conditions of Article 11.
9.2. The winner has 15 days from notification to confirm acceptance of their prize and provide the information needed (identity and, for minors, the parent or guardian's agreement). After this period, or if the winner cannot be reached, the prize is deemed declined and may be awarded to the next entrant in the ranking or cancelled, at the Promoter's choice.
9.3. Gift cards are, where applicable, delivered in digital form. For a physical prize delivered to a winner resident in Switzerland or the United Kingdom (outside the European Union), customs duties and/or import VAT may apply; the Promoter may, at its option, source the prize from a local distributor in order to spare the winner that charge, failing which such charges remain the winner's responsibility.
Article 10 — Personal data
The data collected (username, email address, activity data and, for the winner, the information needed for delivery) are processed by the Promoter, as data controller, solely to manage the Challenge, draw up the ranking, contact the winner, deliver the prize and communicate the results.
- Legal basis: performance of these rules to which the entrant has agreed and, where applicable, consent for optional communications.
- Retention: for as long as necessary to manage the Challenge and deliver the prize, plus any applicable statutory retention periods, and then deletion or anonymisation.
- Rights: access, rectification, erasure, restriction, objection, portability, by writing to contact@quizelo.app. A complaint may be lodged with the competent authority: CNIL in France (www.cnil.fr); ICO in the United Kingdom (ico.org.uk); PFPDT in Switzerland. Processing complies with the GDPR, with the UK GDPR / Data Protection Act 2018 (UK entrants) and with the nFADP (Swiss entrants).
Article 11 — Communication of results
By the sole fact of entering, the winner authorises the Promoter to publish their username and rank on Quizelo's communication channels, for the purpose of announcing the results, without this giving rise to any right to payment. Any use beyond this (name, image, testimonial) is subject to the winner's separate express agreement and, for a minor, that of their parent or legal guardian. To comply with the UK CAP Code, the Promoter will make available, on request sent to contact@quizelo.app, the surname and county of a winner resident in the United Kingdom; any winner may object to this publication without this affecting their right to the prize.
Article 12 — Amendment or cancellation
The Promoter may amend, extend, shorten, suspend or cancel an edition of the Challenge in the event of force majeure, lasting technical impossibility, large-scale fraud compromising the integrity of the ranking, a change in law or regulation, or a decision by an authority or a distribution platform preventing operation of the App. Any amendment is brought to entrants' attention within the App before it takes effect and may not deprive an entrant of rights already acquired. If an edition is cancelled, the prize owed to a winner already determined remains theirs.
Article 13 — Acceptance of the rules
Entry in the Challenge implies unreserved acceptance of these rules and of the applicable laws and regulations. Breach of the rules results in the entrant's exclusion.
Article 14 — Availability of the rules
These rules are available free of charge throughout each edition within the App and on the Quizelo website.
Article 15 — Disputes and governing law
These rules are governed by French law. For entrants resident in Belgium, Switzerland or the United Kingdom, the mandatory consumer-protection provisions of their country of residence remain reserved, and those entrants keep the right to bring proceedings before the courts of their country of residence where the applicable law guarantees them that right. Any complaint must be sent in writing to contact@quizelo.app within 30 days of the end of the edition concerned. Failing an amicable resolution, any dispute will be submitted to the competent French courts, subject to the mandatory jurisdiction rules applicable to consumers.
